Frequently Asked Questions

Common questions about this calculator.

What are California's daily overtime rules?

In California, non-exempt employees must be paid 1.5× their regular rate for hours over 8 up to 12 in a single workday, and 2× (double time) for hours over 12 in that day. On the 7th consecutive workday, the first 8 hours are 1.5× and hours beyond 8 are 2×.

Does California have weekly overtime too?

Yes — employees also earn 1.5× for hours over 40 in a workweek. California applies whichever rule (daily or weekly) yields the higher pay, but hours are not double-counted. Our calculator models the daily rule for a single workday.

Who is exempt from California overtime?

Exempt employees generally include executive, administrative, and professional workers who meet both a duties test and earn at least twice the state minimum wage as a monthly salary. Most hourly workers are non-exempt and covered by daily overtime rules.
